TERMS & CONDITIONS

Effective Date: April 23, 2026

These Terms & Conditions (“Terms”) govern all services provided by Tru Media (“Company,” “we,” “us,” or “our”), a registered business based in California, United States. By engaging our services, purchasing digital products, or accessing our website, you agree to be bound by these Terms.

1. SERVICES

Tru Media provides creative and digital services including but not limited to:

  • Branding (strategy and identity design)

  • Website design and development

  • Website redesigns

  • Monthly retainers (social media, email marketing, content creation)

  • A la carte services (updates, edits, and additional design work)

  • Media buying and paid advertising management

  • Digital products (templates, guides, and resources)

  • Educational content or academy offerings (where applicable)

All services are custom and subject to individual project scope agreements.

2. PAYMENT TERMS

A 50% non-refundable deposit is required to begin any project. The remaining balance is due according to the payment schedule outlined in the invoice or agreement.

All payments must be made on time. Failure to complete payment may result in suspension or termination of services.

Projects that remain unpaid for 30 days after completion or invoice due date may be permanently deleted, including website files and assets, even if the project has been partially or fully completed.

3. CONSULTATION FEE

A $125 consultation fee is required for all new inquiries. This fee is applied as credit toward the total project cost if the client proceeds. This fee is non-refundable and serves to ensure serious inquiries only.

4. REFUND POLICY

All payments, including deposits and project payments, are non-refundable under any circumstances once work has begun.

5. PROJECT TIMELINES

Project timelines are estimated only and depend heavily on client communication, feedback, and timely delivery of required materials.

Delays caused by the client, including late responses or missing assets, will result in adjusted timelines. Tru Media is not responsible for delays outside of our control.

6. CLIENT RESPONSIVENESS

If a client becomes unresponsive for 14 consecutive days, the project will be placed on hold. After 14 additional days of continued inactivity, the project will be considered terminated.

In such cases:

  • No refunds will be issued

  • The project will not be resumed in the future

  • All deliverables and access may be revoked

7. REVISIONS

Each project includes up to three (3) revision rounds. Any additional revisions beyond this limit will incur a fee of $125 per revision.

8. CLIENT CONDUCT

All clients are expected to communicate in a respectful and professional manner at all times.

Tru Media reserves the right to refuse service, suspend communication, or terminate any project if a client behaves in a hostile, disrespectful, or inappropriate manner.

Engaging Tru Media does not constitute employment or entitlement to service under any circumstances.

9. COMMUNICATION & BUSINESS HOURS

Our standard business hours are Monday through Friday, 9:00 AM to 5:00 PM PST.

Communication outside of these hours is not guaranteed.

Requests for work, communication, or updates outside of standard business hours may be subject to an additional fee, at our discretion.

10. PROJECT TERMINATION

We reserve the right to terminate any project at our discretion if terms are violated, communication is inconsistent, or conduct is deemed inappropriate.

In the event of termination:

  • All rights to unfinished work remain with Tru Media

  • No refunds will be issued

  • Access to files or work may be revoked

11. MONTHLY RETAINERS

All monthly retainer services require a minimum commitment of 90 days.

  • Early cancellation is not permitted before the 90-day period

  • No refunds are issued for unused time

  • Services do not roll over unless explicitly stated

12. INTELLECTUAL PROPERTY

Upon full payment, final deliverables are transferred to the client for personal or business use.

Tru Media retains the right to display all completed work in portfolios, case studies, marketing materials, and social media unless otherwise agreed in writing.

13. DIGITAL PRODUCTS

All digital products, including templates and guides, are for personal or business use only.

  • No resale, redistribution, or reproduction is permitted

  • All sales are final and non-refundable

  • Access is granted immediately upon purchase

14. RESULTS DISCLAIMER

Tru Media does not guarantee specific results from branding, marketing, advertising, or media buying services. Outcomes depend on multiple factors including market conditions, client execution, and external variables outside of our control.

15. MEDIA BUYING & ADVERTISING

For media buying services, advertising budgets are the responsibility of the client unless otherwise stated.

We do not guarantee specific financial results or performance metrics from paid advertising campaigns.

16. LIABILITY LIMITATION

To the fullest extent permitted by law, Tru Media shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website.

17. GOVERNING LAW

These Terms shall be governed and interpreted in accordance with the laws of the State of California, United States.

18. CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. Continued use of our services constitutes acceptance of any updated Terms.
